GENERAL TERMS AND CONDITION

ARTICLE 1 : OBJECT

 

This hereby establishes the current General Terms and Conditions of Sale of services provided by LYON TUK TOUR, that is to say, the organiZation of guided tours on electrically assisted Tuk Tuk with a driver, following predefined routes, allowing one to discover the city of Lyon.

Visits are carried in French or English.

 

ARTICLE 2 : GENERAL RULES

 

The hereby established General Terms and Conditions of Sale are reserved solely for consumers, defined under law and jurisprudence, acting exclusively on their own behalf.

In accordance with articles L. 111-1 and L. 111-3 from the Consumer Code, the main characteristics and price of Goods and Services sold electronically are available on the internet site: lyontuktour.com. The hereby established General Terms and Conditions of Sale are applied to all sales of Goods and Services by the LYON TUK TOUR Limited Liability Company.

The hereby established General Terms and Conditions of Sale apply to all CLIENTS who participate in the services sold by LYON TUK TOUR, even if the CLIENT has not reserved the service him/herself. By participating in the sold service, the CLIENT is deemed to have accepted the stated General Terms and Conditions of Sale.

The Special Conditions of Sale of each tour (price, route chosen, etc), as well as the General Conditions of Sale will be in effect on www.lyontuktour.com as of the date of confirming the reservation. LYON TUK TOUR reserves the right to change all or a part of the hereby established General Terms and Conditions of Sale at any time. The CLIENT declares he or she has read the hereby established General Terms and Conditions of Sale before validating the reservation. The validation of the reservation implies full acceptance of the hereby established General Terms and Conditions of Sale.

 

ARTICLE 3 : RESERVATION

 

3.1 Availability

Reservation of a service sold by LYON TUK TOUR must be carried out 72 hours in advance. If you have not reserved within this time, LYON TUK TOUR will not be able to guarantee the reservation.

3.2 Reservation Procedures

Reservation of a service sold by LYON TUK TOUR is made by telephone on 0033 (0)651 360 564, by e-mail at contact@lyontuktour.com or directly on-line atwww.lyontuktour.com. In all the above cases, reservation is only deemed valid if LYON TUK TOUR has confirmed so by e-mail.

 

ARTICLE 4 : PAYMENT

 

The CLIENT pays for his/her reservation by check or bank transfer on the day of the tour at the latest.

For “GROUPS AND COMPANIES” clients, an account representing 50% of the taxes included amount given on the quotation is needed by check at the following address : SARL LYON TUK TOUR, 79 rue Villon, 69008 Lyon, or by bank transfer (LYON TUK TOUR’s GNI available on the website).

ARTICLE 5 : CANCELLATION AND REIMBURSEMENT

5.1 Cancellation of the reservation by the client “INDIVIDUAL”

If the CLIENT intends to cancel his/her reservation, he/she must inform LYON BIKE TOUR at least 72hrs before the beginning of the reserved tour, by e-mail at the following address:

contact@lyontuktour.com, by telephone at the following number: 0033 (0)651 360 564 or by registered post with acknowledgment of receipt to the following address: SARL Lyon Tuk Tour, 6 rue de la Piémonte, 69009 Lyon, France. In the event of cancellation by registered post with acknowledgement of receipt, the date of receipt of the letter will be taken into account to calculate the aforementioned time limit.

Reimbursement will be carried out by bank transfer within the thirty days following cancellation.

Any cancellation, made under 72 hrs before the date and time of the reserved service, will not be accepted or reimbursed by LYON TUK TOUR. Any part or total interruption of the service on behalf of the CLIENT will not result in reimbursement or compensation.

 

5.2 Cancellation of the reservation by the client “GROUPS AND COMPANIES”

Any cancellation or modification of the service or of the number of participants 1 week before the beginning of the ordered service will not be taken into account when billing. In the case of a total cancelling of the service 1 week before ordered service, the account of 50% of the total amount (all taxes includes) will be cashed entirely. In case of modification of the number of participants less than 1 week before the ordered service, the amount of the quotation signed at the beginning will be billed. For any modification more than a week before the service begins, the client must inform LYON TUK TOUR in order to edit the quote by emailing contact@lyontuktour.com, by phone on 0033 (0)651 360 564 or by  by registered post with acknowledgment of receipt to the following address: SARL Lyon Tuk Tour, 79 rue Villon, 69008 Lyon, France.

5.3 Cancellation of the service by LYON TUK TOUR

LYON TUK TOUR reserves the right to cancel a reserved service if the safety or well-being of the participants are at stake. The decision to go ahead with the service or cancel it belongs to LYON TUK TOUR. In the event of cancellation by LYON TUK TOUR, the latter commits itself to reimbursing the CLIENT in full. If the service is stopped after having started, LYON TUK TOUR commits itself to reimbursing all, or part of, the paid amount, after the latter has evaluating the sum.

Reimbursement will be carried out by bank transfer within thirty days from the day of cancellation.

 

ARTICLE 6 : SERVICE

 

The contents of the service are laid out on the website www.lyontuktour.com. LYON TUK TOUR provides the CLIENT with an electrically assisted Tuk Tuk and its driver, to undertake a predefined tour with a guide.

 

6.1 The electric Tuk Tuk

The electric Tuk Tuk is a vehicle with a transport capacity of 6 people (4 adults at max) + 1 driver, accessible to everyone.

 

6.2 Access to services

Access to services offered by LYON TUK TOUR is open to minor children of 2 to 18 years old provided he/she is accompanied by an adult.

 

6.3 How the tour works

The driver will take the customers to the previously defined meeting point for a private guided tour of Lyon of 1 or 2 hours.

 

It is absolutely necessary for the client up to show up at the meeting point at least 5 minutes prior to departure. Hours indicated on the reservation’s confirmation must imperatively be respected. Any late on the predefined schedule may result in cancellation of the visit, without giving rise to any reimbursement or compensation.

 

6.4 The guide

Prior to departure, the guide will talk you through the safety regulations and explains the course of the visit.

The guide decides on its own the rhythm of the visit, the breaks and the itinerary. The driver reserves the right to cancel the tour, or change the route if the safety or well-being of the participants are at stake.

 

6.5 Condition of Client’s participation

The CLIENT commits to a reasonable and prudent attitude on the board of the vehicle. The CLIENT is solely responsible for his/her behavior on public roads. LYON TUK TOUR will not be held accountable for any accident which resulted from the behavior of the CLIENT or third-party.

 

ARTICLE 7 : RESPONSIBILITY – INSURANCE

 

LYON TUK TOUR provides its clients an eletric Tuk Tuk in proper working order, regularly serviced, which adheres to current regulations and safety requirements. LYON TUK TOUR has taken out a liability insurance.

Safety regulations are given by the driver by the time of the visit, which the CLIENT commits to respect.

Safety regulations are sent by email to each client who has reserved. LYON TUK TOUR cannot be held accountable for any damage caused to the CLIENT during the visit. The CLIENT is solely responsible for any damages he/she causes to third parties or other participants in the tour. Parents or legal representatives of a participating minor will be held responsible for any damage caused by the latter during the tour. The CLIENT is informed that he/she must take out liability insurance, covering him/her in the event of any damages during the tour. If such insurance has not been taken out, LYON TUK TOUR cannot be held accountable for this lack of personal guarantee.

 

ARTICLE 8 : DAMAGES

 

In case of deterioration of the Tuk Tuk or its equipment, the CLIENT agrees to pay compensation to LYON TUK TOUR by way of damages evaluated at a maximum amount according to the updated norms available at this address : www.lyontuktour.com which are the following :

The following items broken, stolen or damaged :

Theft or complete damage : 25 000 Euros – Bench : 450 € – Tire : 300 € – Engine : 15 000 € – Battery : 3500 € – Mud-guard : 350 € – Front lights : 200€ – Rear lights : 200€ – Front fork : 3000 € – Tarpaulins : 500€ – Vehicle storage : 500 € SEE INSURANCES

The CLIENT declares he/she has read this barometer and agrees to pay the predetermined damages fast soon as LYON TUK TOUR makes the request.

 

ARTICLE 9- AUTHORIZATION TO PUBLISH PHOTOGRAPHS

 

Whilst the tours and services are underway, photographs of CLIENTS may be taken.

The CLIENT is informed and accepts that the photographs in which he/she features may be published by LYON TUK TOUR for promotion purposes on its website or on social networks like Facebook, Instagram, Twitter …

The CLIENT who does not wish the photographs in which he/she features to be published on LYON TUK TOUR’s website must inform LYON TUK TOUR before the tour starts, or afterwards by email at the following address : contat@lyontuktour.com

 

ARTICLE 10- CONFLICT, LEGAL AUTHORITY AND APPLICABLE LAW

 

The hereby established General Terms and Conditions have been written, interpreted and applied according to French law, the interpretation having been carried out in French, in the event the significance of a term or measure in the hereby established document were to be contested. In the event of a legal dispute, the French text, and not its translation into one or several languages, would be used as evidence.

Subject to public policy clauses applicable in terms of jurisdiction, the courts of the LYON TUK TOUR registered office will be the only competent authority to examine any legal dispute concerning the interpretation or execution of the hereby established document.

A waiver by one of the parties of one clause in the Contract cannot be interpreted as a waiver of another clause in the Contract.

The possible annulment of a clause in the Contract will not bring about a annulment of all, or a part of, the Contract: such a clause will be deemed unwritten.

The previous titles of this present Contract remain indications only. In the event of difficulty with the interpretation of one of these titles, or a measure of the present Contract, the titles will be declared inexistent.
